The year 2007 resulted in an unprecedented amount of amendments to the rules and regulations affecting goods imported and exported from China. Many of the
rules were issued to address the fundamental economic issues of managing the trade surplus and guiding the growth of certain industries. This year’s regulatory
revisions culminated with the issuance of a number of regulations released in December 2007 that became effective in January 2008.

For the past few weeks there have been significant developments in the transfer pricing landscape of the People Republic of China (“PRC”) that
warrant companies reviewing their approach towards PRC transfer pricing planning and compliance. Following our tax alert of December 12, summarizing
the impact and implications of the newly issued Corporate Income Tax Law (“CIT Law”) and Corporate Income Tax Law Implementation
Rules (“CITLIR”), this issue focuses on the recent developments of the PRC transfer pricing landscape including the changes brought about by the new rules.
