Legal News: Neuerungen im Arbeitsvertragsrecht
Mit der angenommenen Abstimmungsvorlage zur Ausdehnung des Freizügigkeitsabkommens auf die 10 neuen EU-Staaten wurde gleichzeitig die Revision der flankierenden Massnahmen verabschiedet. Eine dieser Massnahmen ist die Kontrolle der Lohn- und Arbeitsmarktbedingungen. Um ein mögliches Lohn- und Sozialdumping zu verhindern, wurden daher die so genannten tripartiten Kommissionen zur Kontrolle in den Betrieben eingesetzt. Ihre Arbeit soll durch den neuen Artikel 330b des Schweizerischen Obligationenrechts (OR) unterstützt werden.

Legal News: Modifications dans le domaine du droit du travail
L’issue positive de la votation sur l’extension de l’accord concernant la libre circulation des personnes aux dix nouveaux Etats membres de l’Union européenne a également eu pour effet d’entériner la révision de ses mesures d’accompagnement. L’une de ces mesures porte sur le contrôle des conditions de travail et de salaire. Pour éviter un éventuel dumping salarial et social, des commissions tripartites ont été instituées afin de procéder à ces contrôles au sein des entreprises. Leur travail s’appuiera sur le nouvel article 330b du Code suisse des obligations (CO).

Legal News: Amendments to the employment contract law
The yes vote in the referendum on expanding the vested benefits agreement to the 10 new EU member states was followed by a green light for the revision to the accompanying measures. One of these measures includes a system to monitor salary and labour market conditions. In order to avoid potential wage and social dumping, so-called tripartite commissions have been set up to carry out the necessary operational checks. Their work is to be supported by the new Article 330b of the Swiss Code of Obligations (OR).
